Terms and Conditions

Your Notts Directory – Terms and Conditions of Use

A joint service provided by Nottingham City Council and Nottinghamshire County Council

By registering for and using the Your Notts Directory website (“the Website”), you agree to these Terms and Conditions (“Terms”). These Terms explain your responsibilities, how your content (“Content”) may be used, and the legal responsibilities you hold when uploading information.

If we discover or suspect that you have breached these Terms, we may suspend or terminate your account immediately and without notice.

1. Your Account Security

When you register, you will be required to create a username and password (“Account”). You must:

  • keep your login details confidential and secure
  • ensure that only you are using your Account
  • notify us immediately if you become aware of any unauthorised use or security breach

You are responsible for all activity that occurs under your Account.


2. Your Content

“Content” means any text, images, testimonials, documents, data, or other material you upload.

By submitting Content, you confirm that:

2.1 Accuracy, Ownership and Rights

  • All Content is accurate, true, and up to date.
  • Any opinions expressed are genuinely held by you.
  • All Content is your own original work, or you have obtained full rights, permissions, and licences to publish it.

2.2 We May Moderate Content

Your Content may be:

  • reviewed, edited, moderated, removed, rejected, or deleted at our discretion
  • used on the Website in any format required for the operation of the service

Moderation does not transfer legal responsibility for your Content to the councils.


3. Your Responsibilities as Data Controller

Where your Content includes personal data or special category personal data relating to any third party (including images, staff details, case studies, testimonials, personal stories, or identifiable service users):

  • You act as the Data Controller for that data
  • You hold full legal responsibility under UK GDPR
  • The Website acts only as a facilitator, not a Data Processor

This means you are solely responsible for ensuring that:

3.1 Lawful Basis and Consent

  • You have identified a valid lawful basis for processing the personal data.
  • You have obtained explicit, GDPR‑compliant consent where required.
  • Individuals understand how their data will be used, stored, and displayed.
  • Individuals know how they can withdraw consent and how you will action that.

3.2 Consent for Images of Individuals

If your Content includes images of identifiable people:

  • you must obtain their clear and informed consent before upload
  • you must ensure they understand the image will appear publicly on Your Notts Directory
  • you must remove the Content promptly if consent is withdrawn
  • you must retain reliable records of consent and provide To Nottingham City Council or Nottinghamshire County Council if requested

3.3 Consent for Testimonials

If you upload a testimonial that identifies or refers to a specific individual:

  • you must obtain their explicit written or recorded consent
  • the individual must understand the testimonial will be publicly visible
  • you must retain proof of consent and manage any withdrawal requests
  • you must update or remove testimonials if consent is withdrawn

3.4 Information Rights Requests

As Data Controller, you are solely responsible for:

  • all Information Rights Requests relating to the personal or special category data you use on your listing
  • responding to Subject Access Requests
  • rectification, responding to, restriction, objection, and erasure requests
  • managing and responding to complaints from individuals whose data you have processed in using/uploading that content

Nottingham City Council and Nottinghamshire County Council will not respond to these requests on your behalf, nor do they act as Data Controller or Data Processor for this data.


4. Acceptable Use of Content

Your Content must not:

  • breach copyright or any third‑party intellectual property rights
  • breach confidentiality, contracts, or privacy obligations
  • include defamatory, offensive, obscene, harassing, or discriminatory material
  • contain unlawful, misleading, or harmful information
  • bring any person or organisation into disrepute
  • include personal/special category data without appropriate consent and legal justification

5. Personal Data You Provide to Register Your Account

Personal information you supply during registration (“Your Personal Data”) will be used by Nottingham City Council and Nottinghamshire County Council to:

  1. administer your Account
  2. make decisions about your Content, including moderation
  3. contact you about updates or changes required to your listing
  4. ensure your provider information remains accurate

Your Personal Data will be handled in accordance with each council’s Privacy Policy and UK GDPR.


6. Misuse, Complaints and Reporting Issues

You may contact us using the details on the Website if you:

  • believe your rights have been infringed
  • wish to report misuse of Content
  • want to complain about Content published on the Website

We take all reports seriously and may remove or restrict Content or Accounts where appropriate.


7. Account Termination

You may close your Account at any time using your Account settings.

After termination:

  • these Terms will remain in effect
  • your Content may remain visible on the Website
  • we may retain, remove, or moderate Content at our discretion

We may suspend or terminate your Account immediately if you breach these Terms, or where required for technical, operational, or security reasons.


8. Governing Law

These Terms are governed by the laws of England.
Any disputes relating to these Terms or the Website will be resolved exclusively by the English courts.
